No Good Deed Goes Unpunished: Navigating Antitrust Issues with ESG Collaborations
Over the last several years, public and private companies have been under increasing pressure from key stakeholders to implement ESG criteria when identifying material risks and growth opportunities. Notwithstanding that companies may be pursuing results consistent with public policy (and potentially mandated due to federal rulemaking currently in progress), ESG activities that involve collaboration among competitors may still give rise to antitrust risk. This session will explore these antitrust risks and discuss best practices for managing them.
