Thompson Hine’s Privacy & Cybersecurity team invites you to join us in celebrating Data Privacy Day 2024. Held annually on January 28, Data Privacy Day is an international effort aimed to “create awareness about the importance of respecting privacy, safeguarding data and enabling trust.”
Following an active privacy and cybersecurity year in 2023, we anticipate 2024 will build on this momentum with developments that will continue to shape the evolving privacy and cybersecurity landscape. In honor of Data Privacy Law Day 2024, the following data privacy and cybersecurity developments should be considered:
- In the first few weeks of 2024, New Jersey and New Hampshire have already passed or are on the verge of passing comprehensive privacy bills.
- In 2024, data privacy laws in Texas, Oregon, Montana, and Florida will go into effect. Additionally, Kentucky, New York, Hawaii, and Oklahoma all have privacy laws that have passed at least one chamber of their state legislatures, making them ripe for passing in 2024.
- In March 2024, the delayed enforcement of the new CPRA regulations in California will finally begin to be enforced.
- The Washington My Health My Data Act will go into effect in March 2024, and similar health privacy laws are expected to be introduced or passed across the country.
- The FTC is anticipated to amend the Health Breach Notification Rule to broaden the types of entities subject to the rule.
- The Children’s Online Privacy Protection Act (COPPA) is expected to be expanded through new proposed regulations.
- The FTC amended Gramm-Leach-Bliley Act’s Safeguard Rule, requiring notifying the FTC within 30 days of a data breach discovery, will go into effect in May 2024.
In addition, AI will be a large focus of legislatures and consumers globally. Both the EU AI Act and President Biden’s executive order indicate swift action in response to the AI developments of the past year. However, we expect broad federal AI legislation, like the federal omnibus privacy legislation, to lack significant traction, especially in an election year.
