We work closely with our bankruptcy, litigation, tax and corporate finance teams to provide effective representation on all issues our clients are likely to face in complex transactions.

  • Representing financial services corporation in more than $250 million in construction, mortgage and leasehold mortgage loans for acquisition, construction or refinance of automobile dealership properties in Alabama, California, Colorado, Connecticut, Florida, Georgia, Hawaii, Illinois, Indiana, Louisiana, Maryland, Massachusetts, Minnesota, New Jersey, New Mexico, New York, North Carolina, Ohio, Oklahoma, Oregon, Pennsylvania, Virginia and Washington.
  • Representing national bank in more than $116 million in construction and bridge loans to the developer and operator of medical office buildings on hospital and university campuses in Kentucky, Maine, Virginia, Michigan, California and Florida. Also represented the bank in an amendment to increase an obligated group credit facility to $99 million; facility is secured by nursing homes and other senior living facilities in Florida, Georgia, North Carolina and Tennessee.
  • Representing lender in a $9 million construction loan for renovation of an office/warehouse facility in Cincinnati, Ohio.
  • Representing national bank as agent bank and co-lender on approximately $500 million in secured and unsecured lines of credit for agent bank and co-lenders to REITs in the office, multifamily, retail and industrial sectors.
  • Representing lenders on construction loans in various states, secured by multifamily, office and retail projects.
  • Representing lender in a mezzanine loan in the amount of $28.5 million for an apartment project in Marina del Rey, California having a total project cost of approximately $150 million and the sale of a portion of the mezzanine loan to an investor.
  • Representing mezzanine lender in $5 million loan for the construction of a $91 million apartment project in Englewood, New Jersey.
  • Representing national financial institution as lender in $30 million loan workout of a partially completed multi-phased high-end planned residential marina community along Georgia coast.
  • Representing lender in numerous loan and equity mezzanine financings in connection with $10 million to $80 million transactions related to acquisition and/or construction of upscale apartment buildings and mixed-use facilities in Arizona, California, Florida, Massachusetts, New Hampshire, New Jersey and Tennessee.
  • Representing Fannie Mae DUS lender, letter of credit issuer, construction lender and long-term lender and assisted with $200 million in financings for LIHTC properties and other multifamily projects located in various states and Puerto Rico.
  • Representing lender concerning potential default and bankruptcy issues under acquisition and development loan agreement and revolving residential construction loan agreement for projects in New York, including application of  New York mortgage taxes to mortgages securing revolving credit agreements.
  • Representing lender as letter of credit provider in disposition of purchased bonds acquired with proceeds of draw on letter of credit following default of projects, including low-income housing tax credit projects.
  • Representing lender in workouts and non-judicial foreclosures of single loans and loan portfolios secured by vacant and improved residential lots and subdivisions, and judicial confirmations to obtain deficiency judgments.
  • Representing lender in workouts and non-judicial foreclosures of shopping centers and other commercial buildings and in UCC Article 9 foreclosures.
  • Representing mezzanine lender for $6.78 million loan for acquisition of 388-unit apartment complex in Washington state.
  • Representing lead lender for $170 million in construction financing to tenants-in-common borrower parties for multifamily apartment projects in Arizona and Nevada.
  • Representing lender in connection with more than 125 loans to refinance apartment complexes in Ohio, Michigan, Pennsylvania, West Virginia and Kentucky.
  • Representing lead bank on workout of multilender, multistate construction line of credit for assisted living facilities.
