DOL Again Enters the Investment Advice Fray With Proposed Retirement Security Rule

On October 31, the U.S. Department of Labor (DOL) issued the proposed Retirement Security Rule (Proposed Rule), which would amend the existing rule that defines when a person is an investment advice fiduciary under the Employee Retirement Income Security Act of 1974, as amended (ERISA), and the Internal Revenue Code of 1986, as amended (Code). The DOL simultaneously issued proposed amendments to various class prohibited transaction exemptions (Exemptions), which are intended to narrow and harmonize the exemptions available to address conflicts of interest with respect to investment advice. Department of Commerce Issues Further Export Controls Targeting China’s Semiconductor Manufacturing and Advanced Computing

On October 25, 2023, the Department of Commerce’s Bureau of Industry and Security (BIS) published two significant Interim Final Rules updating the agency’s October 7, 2022, rulemaking that target support for China’s semiconductor manufacturing items, software, and technology and access to advanced computing. According to Commerce Secretary Gina Raimondo, these updated rules “will increase effectiveness of [U.S.] controls and further shut off pathways to evade our restrictions. These controls maintain our clear focus on military applications and confront the threats to our national security posed by the [Chinese] Government’s military-civil fusion strategy.” Read more.
