The FTC is poised to issue a new rule early next year ending or significantly restricting noncompetition agreements. Even if noncompetes survive the final FTC rule, there is a growing list of state laws prohibiting or restricting their use. A company’s most protected information, processes, and relationships could be at risk if key employees can no longer be prevented from going to work for a direct competitor.
